1. Eligibility and acceptance
You must be at least 18 years old, have legal capacity to enter a contract, and provide accurate information to use Backway. If you use Backway for an organization, you confirm that you are authorized to bind it. Mandatory consumer rights that cannot legally be waived remain unaffected.
2. Backway’s marketplace role
Backway provides technology for users to find independent drivers with compatible routes, exchange shipment requests and offers, process supported payments, follow status updates, and confirm delivery. Independent drivers—not Backway—provide transportation services and control how they perform them, subject to law and their agreement with the user.
Backway is not the carrier, employer, agent, insurer, owner, or operator of a driver or vehicle. Matching or verification tools do not guarantee that a user, driver, route, vehicle, or shipment will meet every requirement.
3. Accounts and verification
You are responsible for accurate account information, protecting credentials and OTP codes, and activity performed through your account. Notify support promptly about suspected unauthorized access. Backway may request information reasonably needed to verify identity, driver eligibility, or vehicle documentation and may reject or suspend incomplete, expired, misleading, or fraudulent accounts.
4. Driver responsibilities
Drivers must maintain all licences, registrations, permits, qualifications, vehicle standards, and insurance required for their routes and services. Drivers are responsible for inspecting shipment information, deciding whether they can safely and legally transport it, protecting the shipment while in their custody, communicating material delays, and completing delivery as agreed.
5. User and shipment responsibilities
Users must provide accurate pickup, delivery, recipient, size, weight, contents, value, and handling information; use suitable packaging; obtain any required permissions; and ensure someone authorized can release and receive the shipment. The user is responsible for information provided about a recipient or another person.
Unless Backway expressly approves otherwise, you may not offer illegal or stolen goods; weapons or ammunition; controlled drugs; hazardous or dangerous materials; cash, negotiable instruments, or high-value valuables; live animals; or goods requiring special licences, temperature controls, or regulatory handling. A driver may reject any shipment that differs materially from its description or appears unsafe or unlawful.
6. Offers, negotiation, and AI guidance
Drivers and users negotiate directly through offers and counter-offers. An accepted offer establishes the agreed shipment price and service details shown in the app, subject to payment. AI price suggestions are estimates based on route, distance, and configured assumptions. They are not guarantees, appraisals, or binding prices, and either party may accept, reject, or counter them.
7. Payments, fees, and taxes
Supported payments are processed by third-party payment providers. Backway does not store complete payment-card or bank credentials. The price, applicable platform fees, taxes, and other disclosed charges are shown before confirmation. You authorize the provider to process the transaction, refund, chargeback, or driver payout information needed for the service. Each party remains responsible for its own tax obligations.
8. Cancellations and refunds
A request may be withdrawn without charge before payment. If a paid shipment is cancelled because the selected driver becomes unavailable or invalid, the user is entitled to a full refund of the shipment payment. After payment, other cancellations and any applicable fee or refund depend on the shipment stage and the rules shown in the app before confirmation.
Negotiations may end without charge when no price is agreed. A request may also close if payment is not completed before the driver passes the pickup city. Payment-provider processing times may affect when a refund appears.
9. Pickup, delivery, and OTP confirmation
Users and drivers must review shipment status and communicate through the available support channels when a material issue arises. The intended recipient should provide the delivery OTP only after receiving the shipment. A valid delivery OTP records delivery completion and may trigger the next payment or payout status. Sharing an OTP early or with an unauthorized person can affect the ability to investigate a dispute.
10. Risk and insurance
Backway does not insure shipments and does not promise carrier or cargo coverage unless a specific insurance option is expressly offered, purchased, and governed by separate policy terms. Users and drivers are responsible for obtaining insurance appropriate to the shipment and transportation service. Users should avoid sending irreplaceable goods and should accurately declare contents and value.
11. Reviews and acceptable conduct
Ratings and reviews must reflect genuine interactions and must not be unlawful, threatening, discriminatory, deceptive, defamatory, privacy-invasive, or manipulated. You may not misuse the platform, scrape data, bypass security, interfere with another account, arrange fraud, send spam, or use Backway for unlawful activity. Backway may moderate or remove content that violates these Terms while preserving records needed for an investigation.
12. Suspension and termination
Backway may restrict, suspend, or terminate access when reasonably necessary for safety, fraud prevention, legal compliance, non-payment, expired driver documents, material breach, or protection of users and the platform. Where appropriate, we will explain the reason and available review process. Obligations relating to completed transactions, disputes, retained records, intellectual property, and liability survive termination.
13. Intellectual property
Backway and its licensors own the platform, branding, software, design, and related materials. Subject to these Terms, you receive a limited, personal, revocable, non-transferable right to use the service. You retain ownership of content you submit but grant Backway permission to host, process, display, and share it as reasonably required to operate, secure, and improve the service.
14. Availability, disclaimers, and liability
Backway works to keep the platform available and information useful, but routes, drivers, prices, pickup times, delivery times, and service availability can change. To the extent permitted by law, the platform is provided without guarantees of uninterrupted access or a particular shipment outcome.
Backway is not responsible for an independent driver's acts or omissions, inaccurate information supplied by a user, inadequate packaging, prohibited goods, or delays outside Backway's reasonable control. To the extent permitted by law, Backway is not liable for indirect, incidental, special, or consequential loss. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.
15. Privacy
Our Privacy Policy explains how Backway handles personal information. By using location, payment, verification, or delivery features, you acknowledge that the information needed for those features will be processed as described there.
16. Governing law, disputes, and language
Please contact support first so we can try to resolve a concern in good faith. These Terms are governed by the laws of Quebec and the applicable federal laws of Canada, without limiting mandatory rights available where you live. Unresolved proceedings may be brought before a court with competent jurisdiction in Quebec unless mandatory law requires another forum.
French, English, and Arabic versions are provided for accessibility. The French version is made available with equal prominence. No version limits rights provided by Quebec language or consumer law, and the versions should be interpreted consistently wherever possible.
17. Changes and contact
We may update these Terms to reflect service, risk, or legal changes. Material changes will be communicated through the website, app, or another appropriate channel before they take effect when required. Continued use after the effective date means the updated Terms apply to later activity.
